Trademark Registration in India: Steps, Classes and Common Pitfalls

By ATTPL Legal Editorial Team · · 2 min read

How to search, file and protect your brand in India, including the class system, objections and renewal.

Why register

A registered trademark gives you exclusive rights in your class and a stronger base to act against copycats. It also adds value when you license, franchise or raise funds.

Steps

  • Search the Trade Marks Registry database for similar marks.
  • Choose the correct classes for your goods and services.
  • File the application with the applicant's details and proof of use if claimed.
  • Respond to any examination report or objection within the time given.
  • Publication in the journal opens an opposition window.
  • Registration follows if there is no successful opposition; renew after the term.

Common pitfalls

  • Filing in the wrong class.
  • Choosing a purely descriptive name.
  • Ignoring examination reports.
  • Forgetting renewals.

For international brands

Indian filing is separate from other countries. Consider the Madrid Protocol route if you plan to expand abroad.

Choosing a strong mark

Marks that are invented or arbitrary, such as a made-up word, are usually easier to register and protect than descriptive names that simply describe the product. Before investing in packaging and marketing, check the trademark registry for identical or similar marks in your classes and also search the market and domain names. A little research avoids rebranding costs later.

Consider registering both the word mark and the logo, since they protect different things.

Understanding classes and specifications

Trademarks are registered for specific goods or services grouped into classes. A narrow specification may leave gaps, while a very broad one may invite objections. Describe what you actually sell and plan to sell in the near future. If you operate in several areas, such as software and consulting, you may need multiple classes.

Handling objections and enforcing rights

The registry may raise an examination report citing similar marks or other grounds. A well-argued reply with evidence of use often resolves it. After registration, monitor the market and the trademark journal for conflicting marks, send cease-and-desist notices where necessary and keep proof of use and renewal dates in a safe place.
